IMPORTANT: California Extends Compliance Deadline for New Harassment Training Requirements

In response to outcry from the business community, Governor Newsome signed a law extending the deadline for all employers with five or more employees to provide sexual harassment prevention training to their employees by January 1, 2021. Previously, California lawmakers required the sexual harassment prevention training to be completed by January 1, 2020.
What this means for employers
This extension provides another year for employers to comply with the new law to train both their supervisory and non-supervisory employee
The new January 1, 2021 deadline removes the prior concern that supervisors trained in 2018 would need to be trained in 2019 to meet the former January 1, 2020 deadline
Employers who provide legally-sufficient training in 2019 whether doing it to comply with the 1/1/20 initial rule or because they simply wish to do it earlier than the new 1/1/21 deadline, will not be required to provide further refresher training and education until two years thereafter
Moving forward, employers must provide sexual harassment prevention training and education to each California employee once every two years
Employees trained in 2019 will remain on the two-year schedule and will not need to be retrained in 2020
More time for comprehensive and customized sexual harassment prevention training!
Employers will have a choice of using the Department of Fair Employment and Housing DFEH materials published late in 2019 or develop their own training modules for compliance
Employers can decide to use online or interactive training depending on the needs and culture of their company
Employers can determine the best way to prevent future lawsuits
